Talk with your Insurance Company
Don’t get too eager to file a lawsuit against vehicle insurance companies in Texas, or anywhere else for that matter, over the slightest claim dispute. You’ll end up spending a ton of cash and end up nowhere if your policy clearly states that they’re not liable for covering you. Talk to them first and try to sort things out: if you have problems with the amount of money they’re offering, get the second opinion of another independent adjuster or arbiter.
File a complaint with the Texas Department of Insurance (TDI)
If clarifying and working with an insurance company doesn’t yield the results you want and all else fails, you can file a complaint with the TDI. It’s cheaper than getting a lawyer yourself to file a lawsuit, and the state may even step in to provide you legal help. Just don’t expect the TDI to force the insurance company to pay up for a disputed claim or mediate in fault and negligence determination. This is no longer in their jurisdiction, since they only handle policy or legal violations.
